Article 1. Definitions
In these general terms and conditions, the following definitions apply:
- Consumer: a natural person who is not acting for purposes relating to their trade, business, craft or profession.
- Business customer: a natural person or legal entity acting in the exercise of a profession or business.
- Customer: any consumer or business customer who enters into or wishes to enter into an agreement with ZinVolt.
- Agreement: any agreement between ZinVolt and the customer regarding the supply of products, digital services, support or additional services.
- Product: any product offered by ZinVolt, including the ZinVolt Power, ZinVolt Mate, ZinVolt Base, ZinVolt Stack, P1 dongle, cables, accessories and replacement parts.
- Digital service: the ZinVolt app, software, online accounts, cloud services, firmware, links and other digital functionalities associated with a product.
- Website: the webshop and other pages made available by ZinVolt via zinvolt.com.
- Durable data carrier: a means by which information can be stored and later consulted unchanged, such as email or a PDF file.
When these terms and conditions refer to statutory rights of consumers, these rights apply only when the customer acts as a consumer.
Article 2. Applicability
- These general terms and conditions apply to every offer from ZinVolt and to every agreement between ZinVolt and the customer.
- The terms and conditions are made available electronically before placing the order in a way that allows the customer to view, store and print them.
- Deviations from these terms and conditions are only valid if agreed upon in writing or electronically.
- General terms and conditions of a business customer are expressly rejected, unless ZinVolt has confirmed in writing that they are accepted.
- If a provision in these terms and conditions conflicts with mandatory consumer law, the statutory provision applies. The other provisions remain applicable in that case.
- Product information, the order confirmation and individual written agreements take precedence over these general terms and conditions in case of conflict.
Article 3. The offer and product information
- ZinVolt describes the offered products as completely and clearly as possible. The product page states the main characteristics, price, capacity, compatibility, warranty period and any installation conditions.
- Images, animations, drawings and mood images give the most reliable impression possible. Small differences in color, finish, size or design are possible if they do not affect the normal functioning of the product.
- Obvious mistakes, typing errors, programming errors and clearly incorrect prices are not binding on ZinVolt. ZinVolt informs the customer as soon as possible if this is the case.
- Calculations regarding possible savings, payback periods, energy prices, yields and self-consumption are indicative. Actual results depend on circumstances such as energy consumption, solar panels, energy prices, weather conditions, chosen settings and user behavior.
- A calculation, consultation or online selection tool does not guarantee a specific financial result.
- The customer is responsible for providing correct information when ZinVolt provides advice based on energy consumption, the home, solar panels, smart meter or electrical installation.
- Functionalities that depend on third-party services may change. This applies, for example, to dynamic energy prices, energy suppliers, external platforms, smart meters, internet connections, Homey, Home Assistant and other external links.
- A change by an external party does not limit the consumer's statutory rights if an essential promised function is no longer available as a result.
Article 4. Formation of the agreement
- The customer can select products and add them to the shopping cart.
- Before completing the order, the customer has the opportunity to check and correct the order, price, delivery details and chosen payment method.
- By clicking the order button, the customer places an order with an obligation to pay.
- After the order, the customer receives an automatic receipt confirmation by email.
- The agreement is concluded as soon as ZinVolt has accepted the order. Acceptance can be demonstrated by an order confirmation, shipping confirmation or the actual execution of the order.
- ZinVolt may refuse an order in case of insufficient stock, an obvious pricing error, suspected fraud, incorrect customer data, a technical problem or another justified reason.
- If ZinVolt does not accept an already paid order, the paid amount will be refunded as soon as possible.
- The agreement is concluded in the Dutch language.
- The order confirmation, general terms and conditions and mandatory information are provided by email or on another durable data carrier.
Article 5. Prices and costs
- All prices for consumers include VAT, unless clearly stated otherwise.
- Any delivery costs, installation costs and other additional costs will be stated before the order is placed.
- Standard delivery within the Netherlands is free, unless clearly stated otherwise before the order.
- Costs for delivery outside the Netherlands will be stated during the ordering process.
- The price displayed at the time of ordering applies, except in the event of an obvious error that the customer should reasonably have recognized.
- ZinVolt may change prices for future orders. A price change does not affect an already concluded agreement.
- Discount codes, promotions and offers are valid within the specified period and according to the conditions stated therein.
- Discounts cannot be applied retroactively to an order, unless ZinVolt agrees.
Article 6. Payment
- The available payment methods are displayed during checkout.
- Depending on the time of ordering, iDEAL, credit card, Bancontact, SEPA, Klarna and other payment methods may be available.
- If payment is processed through an external payment service, the terms and conditions of that payment service may also apply.
- The customer must pay the amount due within the period stated during the ordering process or on the invoice.
- If a consumer does not pay on time, they will first receive a free payment reminder. The consumer will then be given at least 14 days to pay.
- After the expiry of the period from the payment reminder, ZinVolt may charge statutory interest and legally permitted collection costs.
- A business customer is in default upon expiry of the agreed payment term, unless otherwise agreed in writing.
- ZinVolt may suspend the execution of an order as long as a due amount has not been paid.
Article 7. Delivery
- ZinVolt delivers to addresses and countries that can be selected during the ordering process.
- The estimated delivery time is stated on the product page, during checkout or in the order confirmation.
- A stated delivery date is an estimate, unless a fixed delivery date has been expressly agreed upon.
- If no delivery time has been agreed, ZinVolt delivers a consumer order within the statutory period at the latest.
- For a pre-order or product not yet in stock, the expected delivery period stated on the product page or in the order confirmation applies.
- ZinVolt informs the customer as soon as possible if an order is delayed.
- If ZinVolt does not deliver within the agreed period, the consumer can give a reasonable additional period. After the unused expiry of this period, the consumer may dissolve the agreement, unless an additional period is not necessary given the circumstances.
- If delivery on a specific date was essential and ZinVolt was aware of this before the order, the consumer can dissolve the agreement if that date is missed, insofar as the law allows.
- An order can be delivered in multiple parts.
- The customer must provide a correct and complete delivery address. Reasonable additional costs directly arising from a demonstrably incorrect address can be passed on to the customer.
- If the customer is not present, they must cooperate within a reasonable period to arrange a new delivery appointment.
- ZinVolt remains responsible for the order in a consumer purchase until the consumer or a third party designated by the consumer has received the product.
- If the consumer engages a carrier themselves that was not offered by ZinVolt, the risk may pass to the consumer earlier according to the statutory rules.
- Visible transport damage should preferably be reported as soon as possible with photos. Failure to report damage immediately does not affect the consumer's statutory rights.
Article 8. Retention of title
- All delivered products remain the property of ZinVolt until the full purchase price and any agreed additional costs have been paid.
- The retention of title does not affect the statutory risk distribution in a consumer purchase.
- A business customer may not sell, pledge or otherwise transfer products subject to retention of title to third parties.
Article 9. Installation, use and safety
- The customer must use the product according to the supplied manual, safety regulations and technical specifications.
- The electrical installation, wall socket, fuse box, smart meter, internet connection and other facilities must be suitable for the chosen product.
- Work for which, according to the law, manual or technical situation, an expert installer is required, must be carried out by an authorized expert.
- The customer may not open, disassemble, modify or repair a product if this is not permitted according to the manual.
- The customer may only use compatible expansion modules, cables, parts and accessories.
- A ZinVolt Stack may only be used in combination with a suitable ZinVolt Base and according to the prescribed connection procedure.
- A ZinVolt Mate may only be linked to a compatible ZinVolt Power and according to the applicable instructions.
- The customer must follow safety notices, warnings, firmware updates and recalls.
- In case of damage, overheating, deformation, leakage, smoke, burning smell, unusual noises or other unsafe signals, the product must be switched off if it is safe to do so. The customer must then contact ZinVolt.
- The emergency power connection is intended for devices that can be directly connected to the product according to the manual. The presence of an emergency power connection does not automatically mean that the entire home is supplied with power.
- Damage demonstrably caused by use contrary to the manual may fall outside a commercial warranty. Statutory rights remain valid if the defect was not caused by the customer's actions.
Article 10. ZinVolt app and digital functions
- Certain functions may require a ZinVolt account, internet connection, suitable smartphone, Bluetooth connection, smart meter or P1 dongle.
- The requirements for using digital functions are stated as clearly as possible on the product page or in the manual.
- ZinVolt may update software, firmware and the ZinVolt app to improve operation, security, compatibility or user experience.
- The customer must install necessary security updates and product updates within a reasonable period when ZinVolt makes them available.
- ZinVolt provides updates necessary to ensure a product with digital elements conforms to the agreement for the legally required period.
- Maintenance, security work, malfunctions and work by external service providers may lead to a temporary interruption.
- ZinVolt attempts to communicate announced maintenance in advance when reasonably possible.
- ZinVolt may change functions if there is a valid reason, the change does not cause additional costs and the customer is clearly informed.
- A change may not affect the legal conformity of a purchased product.
- If a change has more than a minor negative impact on the use of a digital service, the consumer will have the legal options to terminate the agreement or demand another appropriate solution.
- The customer is responsible for keeping login details confidential and must report suspected misuse as soon as possible.
Article 11. Legal conformity
- A consumer always has the right to a product that conforms to the agreement.
- A product must have the characteristics that the consumer can reasonably expect based on the agreement, product information, price, nature of the product and public statements.
- Legal conformity is separate from a commercial warranty from ZinVolt or a manufacturer.
- In the Netherlands, there is no fixed general legal warranty period. The expected lifespan depends on the type of product, the price, the use and the information provided at the time of sale.
- If a product does not conform to the agreement, the consumer can claim free repair or replacement according to the legal conditions.
- Repair or replacement will take place within a reasonable period and without serious inconvenience to the consumer.
- If repair or replacement is impossible, does not take place within a reasonable period or cannot be demanded from ZinVolt, the consumer may, under legal conditions, be entitled to a price reduction or dissolution of the agreement.
- ZinVolt, as the seller, is the first point of contact for legal conformity. ZinVolt may use a manufacturer, repairer or other service partner for investigation or execution.
- Costs necessary for a valid claim to legal conformity are for the account of ZinVolt. This may include investigation, transport, parts, labor and return shipping.
- The consumer must report a defect within a reasonable period after discovery. A report within two months of discovery is in any case considered timely.
- When reporting, the consumer provides, as far as reasonably possible, the order number, serial number, a description of the problem and relevant photos, videos or system information.
- ZinVolt may perform a technical investigation or remotely read diagnostic data as far as necessary and consistent with the privacy policy.
Article 12. Additional commercial warranty
In addition to legal rights, ZinVolt offers the following additional commercial warranty:
- ZinVolt Power: 3-year warranty.
- ZinVolt Mate: 10-year warranty.
- ZinVolt Base: 10-year warranty.
- ZinVolt Stack: 10-year warranty.
- The commercial warranty period starts on the date the product was delivered to the original purchaser.
- For accessories, P1 dongles, cables and other products, an additional commercial warranty only applies if this is expressly stated on the product page, order confirmation or in a warranty certificate.
- The commercial warranty applies to material defects, manufacturing defects and defects that arise during normal use within the warranty period.
- In the event of a valid warranty claim, ZinVolt may repair the product, replace a part, replace the product with an equivalent product, or offer another suitable solution.
- ZinVolt will consider the nature of the defect, costs, remaining lifespan, and the customer's interest when choosing a solution.
- A replacement product does not have to be new if a technically equivalent and sound replacement product is supplied. This does not limit the statutory rights of consumers.
- Repair or replacement does not automatically extend the original commercial warranty period, unless stated in a product-specific warranty certificate or required by law.
The commercial warranty does not apply if the defect is demonstrably caused by:
- use contrary to the manual or safety instructions;
- an unsuitable electrical installation or incorrect connection;
- the use of incompatible parts or accessories;
- an alteration, repair, or opening by an unauthorized party;
- dropping, impact, transport by the customer, or other external damage;
- fire, water damage, lightning strike, overvoltage, vermin, or other external influences;
- use outside the permitted temperature, humidity, or other environmental conditions;
- removal or illegibility of the serial number;
- normal wear and tear or normal decrease in battery capacity.
- An exclusion only applies if there is a sufficient connection between the stated circumstance and the defect.
- A specific warranty on minimum remaining battery capacity or a maximum number of charging cycles only applies if expressly stated on a product page, datasheet, or separate warranty certificate.

- The customer must provide the order number, serial number, product type, and a clear description of the problem with the request.
- ZinVolt may request reasonable additional information necessary to assess the claim.
- ZinVolt may engage a manufacturer or service partner for technical investigation. ZinVolt remains the point of contact for the customer, unless the customer voluntarily uses a separate factory warranty.
- The commercial warranty never limits the consumer's right to statutory conformity, free repair, replacement, price reduction, dissolution, or compensation.
Article 13. Right of Withdrawal for Consumers
- A consumer can withdraw from a distance contract within 14 days without giving reasons.
- For the purchase of a single product, the term starts on the day after receipt by the consumer or a previously designated third party.
- For an order delivered in multiple shipments or parts, the term starts on the day after receipt of the last shipment or the last part.
- The consumer may also withdraw from the agreement before delivery.
- The consumer can withdraw by sending an unambiguous statement to support@zinvolt.com.
- The consumer can also use the model withdrawal form at the bottom of these terms and conditions.
- As soon as the digital withdrawal function is available on the website, the consumer can also submit the withdrawal via this function.
- ZinVolt will confirm a digitally submitted withdrawal by email as soon as possible.
- To meet the deadline, it is sufficient for the consumer to send the withdrawal statement before the end of the term.
- The consumer does not have to give a reason for the withdrawal.
Article 14. Return Shipment After Withdrawal
- After withdrawal, the product must be returned or handed over to ZinVolt no later than 14 days.
- Due to weight, value, and transport regulations for lithium batteries, ZinVolt can organize the return shipment or collection.
- The consumer must follow ZinVolt's return instructions and may not send a battery via a random parcel service without consultation.
- ZinVolt will bear the direct costs of standard return shipping for a valid consumer withdrawal if the consumer follows the provided return procedure.
- If the consumer chooses another or more expensive return method without permission, ZinVolt is not obliged to reimburse the additional costs.
- When ZinVolt arranges for the product to be collected, the transport risk transfers to ZinVolt as soon as the product has been handed over to the designated carrier.
- The consumer may unpack and assess the product to the extent necessary to determine its nature, characteristics, and functioning.
- For a home battery, assessing does not mean that it may be used intensively for a longer period, permanently mounted, or used in a way that goes beyond reasonable examination.
- The original packaging is not mandatory to exercise the right of withdrawal.
- ZinVolt may set off any demonstrable depreciation if the consumer has gone beyond what was necessary to assess the product.
- The consumer must pack the product carefully and securely. The use of the original protective packaging is strongly recommended due to the weight and sensitivity of the product.
- The mere absence of the original packaging is not a reason to automatically refuse a return.
Article 15. Refund After Withdrawal
- After a valid full withdrawal, ZinVolt will refund all payments received from the consumer, including the costs of the cheapest standard delivery offered.
- Additional costs for an expressly chosen more expensive delivery method will not be refunded.
- The refund will take place no later than 14 days after receipt of the withdrawal statement.
- ZinVolt may withhold the refund until the product has been received or until the consumer has demonstrated that the product has been returned.
- The refund will be made using the same payment method as the original payment, unless the consumer expressly agrees to another method.
- No fees will be charged for the refund.
- Processing by a bank or payment provider may take additional time after the refund has been initiated.
- In the case of a partial withdrawal, only payments for the returned products will be refunded. The original standard delivery costs do not have to be refunded if the consumer retains part of the order.
- Any demonstrable depreciation may be set off against the refund. In that case, ZinVolt will provide an explanation of the calculation.
Article 16. Services During the Cooling-Off Period
- If the consumer requests a paid service to begin during the cooling-off period, ZinVolt may request an express request.
- If the consumer withdraws after the performance has begun, a proportional amount may be due for the part already performed.
- This amount is only due if the consumer has been correctly informed in advance and has expressly requested that the performance begin during the cooling-off period.
- The right of withdrawal for a fully performed service only lapses if the consumer has expressly agreed in advance to full performance and has acknowledged that the right of withdrawal lapses after full performance.
Article 17. Complaints and Service
- Complaints about an order, product, delivery, digital service, or warranty can be reported via support@zinvolt.com.
- Preferably include the order number, product type, serial number, and a clear description of the complaint.
- ZinVolt will confirm receipt of a complaint as soon as possible.
- ZinVolt aims to respond substantively within 14 days.
- If more time is needed for investigation, the customer will receive an indication of the further processing period.
- A report to the ACM or ACM ConsuWijzer does not constitute a procedure in which an individual dispute is resolved bindingly.
- If the customer and ZinVolt do not reach a solution, the customer can submit the dispute to the competent court.
- A consumer can obtain information about consumer rights from ACM ConsuWijzer.
- A consumer residing outside the Netherlands may seek assistance from the European Consumer Centre in the event of a cross-border dispute.
Article 18. Liability towards Consumers
- ZinVolt is liable for damages for which ZinVolt is liable under mandatory law.
- No provision in these terms and conditions limits liability for death or physical injury due to an attributable shortcoming, intent, conscious recklessness, product liability, or any other liability that cannot be excluded by law.
- The customer must take reasonable measures to prevent further damage.
- ZinVolt is not liable for damage caused solely by incorrect use, unsuitable installation, failure to follow safety instructions, or unauthorized modification by the customer.
- An exclusion only applies to the extent that the damage was actually caused by the circumstance in question.
- ZinVolt does not guarantee any specific financial benefit, energy yield, commercial result, or payback period, unless expressly guaranteed in writing.
Article 19. Liability towards Business Customers
- For business customers, ZinVolt's liability is limited to direct damage that is the direct result of an attributable shortcoming.
- ZinVolt is not liable towards business customers for indirect damage, consequential damage, loss of profit, missed savings, loss of data, or business stagnation.
- The total liability is limited to the amount paid for the relevant agreement or the amount paid out by the liability insurer.
- The limitations do not apply in cases of intent or conscious recklessness on the part of ZinVolt's management, death, physical injury, or liability that cannot be excluded by law.
Article 20. Force Majeure
- ZinVolt is not liable for any delay or failure resulting from a circumstance that cannot reasonably be attributed to ZinVolt.
- Force majeure may include: natural disasters, war, government measures, fire, epidemics, severe transport disruptions, prolonged power outages, cyber incidents, failure of essential suppliers, and international supply chain disruptions.
- ZinVolt will inform the customer as soon as possible if a force majeure situation affects the performance of the agreement.
- During force majeure, obligations may be temporarily suspended.
- If the force majeure lasts longer than 30 days or if performance is permanently impossible, both parties may terminate the unperformed part of the agreement.
- For products or services not delivered, ZinVolt will refund the amounts received.
- This provision does not limit any mandatory rights of consumers in case of late delivery or non-delivery.
Article 21. Privacy and Communication
- ZinVolt processes personal data in accordance with the privacy policy available at zinvolt.com.
- Personal data may be processed for orders, payments, delivery, customer service, warranty, security, the ZinVolt app, and other legitimate purposes.
- Service messages about an order, account, security, update, recall, or product are not commercial marketing messages.
- Placing an order does not automatically mean that the customer consents to newsletters or commercial messages.
- Marketing messages will only be sent when there is a valid legal basis for doing so.
- The customer can unsubscribe from commercial communications via the opt-out option in the message.
Article 22. Intellectual Property
- All intellectual property rights to the website, ZinVolt app, software, texts, images, videos, designs, manuals, and brand expressions belong to ZinVolt or its licensors.
- The customer only receives a personal and limited right of use to the extent necessary to use the purchased product or digital service.
- It is not permitted to copy, modify, publish, sell, or commercially exploit software, firmware, documentation, or other protected materials without permission.
- Statutory exceptions and rights to interoperability remain applicable.
Article 23. Amendment of the Terms and Conditions
- ZinVolt may amend these general terms and conditions for future agreements.
- For an order, the terms and conditions agreed to by the customer at the time of concluding that agreement apply.
- A subsequent amendment will not be applied retroactively to an existing purchase agreement.
- For ongoing digital services, an amendment may occur if there is a valid reason and the law permits it.
- The customer will be informed in advance if an amendment to an ongoing service has noticeable consequences.
- The statutory rights to terminate the agreement in the event of an unfavorable amendment remain.
Article 24. Applicable Law and Disputes
- Dutch law applies to the agreement.
- The choice of Dutch law does not deprive a consumer of the protection of mandatory provisions of the country where the consumer habitually resides, if this protection is applicable under international law.
- Disputes will be submitted to the competent court according to the law.
- A business customer will submit a dispute to the competent court in the district where ZinVolt is established, unless mandatory law dictates otherwise.
Article 25. Final Provisions
- If a provision proves to be wholly or partially void, voidable, or unenforceable, the other provisions remain in force.
- The invalid provision will be replaced by the statutory regulation or by a valid provision that aligns as much as possible with the purpose of the original provision.
- Not exercising a right immediately does not mean that ZinVolt or the customer waives that right.
- Verbal agreements can be valid, but parties are advised to confirm important agreements in writing or by email.
